Axiata refers to the announcement dated 7 December 2009 and wishes to announce that TSDTR had today applied to withdraw the appeals filed to the Court of Appeal against the following High Court’s decisions:-
Allowing TRI and Celcom’s appeal against the decision of the Senior Assistant Registrar (“SAR”) in dismissing TRI and Celcom’s application to strike-out the amended counterclaim of TSDTR (“ Striking-Out Appeal”), and
Allowing TRI and Celcom’s appeal against the decision of the SAR in allowing the re-amendment of TSDTR’s Amended Counterclaim for TSDTR to join 11 present or former directors and officers of TRI and Celcom as defendants in this matter (“Joinder/Amendment Appeal”).
Following the withdrawal of the above appeals, the Court of Appeal consequently ordered:-
The appeals to be struck-out;
TSTDR to pay cost of RM10,000.00 to each respondent for the Striking-Out Appeal; and
TSTDR to pay cost of RM5,000.00 each to each respondent for the Joinder/Amendment Appeal.
