Axiata refers to its previous announcement dated 29 April 2009 wherein it was announced that Datuk Mohd Shuaib Ishak (“MSI”) had filed an application for leave to appeal to the Federal Court against the Order of the Court of Appeal dated 27 March 2009 allowing the appeal by Celcom Axiata Berhad [Formerly known as Celcom (Malaysia) Berhad], a wholly owned subsidiary of Axiata (“Celcom”), and setting aside the Order of the High Court dated 9 July 2008 granting MSI leave to commence a derivative action in Celcom’s name under Section 181A(1) of the Companies Act 1965.

Axiata wishes to announce that the Federal Court today heard and dismissed MSI’s application for leave to appeal and awarded costs of RM15,000 to be paid to Celcom.
