Axiata refers to the announcement by Telekom Malaysia Berhad dated 11 October 2007 in relation to above litigation matter in which Celcom Axiata Berhad [formerly known as Celcom (Malaysia) Berhad] (”Celcom”) had filed a notice of appeal to the Court of Appeal against the High Court’s decision dismissing with costs Celcom’s appeal to strike-out the Statement of Claim by Asmawi against Celcom and Kamsani (“Celcom’s Appeal”).

We wish to announce that the Court of Appeal had today, allowed Celcom’s Appeal and thereby the decision of the Learned Judge of the High Court is set aside and Asmawi’s claim is struck out with costs.

This announcement is dated 17 May 2010.
