Axiata Group Berhad (“Axiata”) refers to Telekom Malaysia Berhad’s announcement dated 28 April 2006 whereby it was announced that Celcom Axiata Berhad [formerly known as Celcom (Malaysia) Berhad] (“Celcom”) was seeking, inter-alia, a declaration that the award of the Arbitral Tribunal dated 2 August 2005 instituted by DeTeAsia against Celcom is contrary to the public policy of Malaysia and is accordingly unenforceable in Malaysia within the meaning of Section 5(2) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1985 (“Originating Summons”).
Axiata wishes to announce that the Court had today allowed DeTeAsia’s application to set aside Celcom’s Originating Summons with costs.
Axiata will make further announcement of any material development on this matter from time to time.
