Axiata refers to Telekom Malaysia Berhad’s previous announcement dated 26 February 2008 and its previous announcement dated 16 September 2008 respectively and wishes to announce that the Court of Appeal had today delivered the following decisions with regard to the above matters:
i. Dismissing Celcom’s appeal against the decision of the High Court in dismissing Celcom’s appeal on the application to strike out the claim by MCAT against Celcom in the 1st Suit; and
ii. Dismissing Celcom’s appeal against the decision of the High Court in allowing the MCAT’s Directors appeal against Celcom’s application to strike out the claim by MCAT’s Directors against Celcom in the 3rd Suit.
Axiata will make a further announcement of any material development on this matter from time to time.
