Axiata refers to the announcement dated 12 November 2009 and wishes to announce that TSDTR had on 4 December 2009 filed an appeal to the Court of Appeal against the following High Court’s decision:-
i. allowing TRI and Celcom’s appeal against the decision of the Senior Assistant Registrar (“SAR”) in dismissing TRI and Celcom’s application to strike-out the amended counterclaim of TSDTR (“TSTDR’s Amended Counterclaim”),and
ii. allowing TRI and Celcom’s appeal against the decision of the SAR in allowing the re-amendment of TSDTR’s Amended Counterclaim for TSDTR to join 11 present or former directors and officers of TRI and Celcom as defendants in this matter.
Axiata will make a further announcement on any material development on this matter from time to time.
