PENGURUSAN DANAHARTA NASIONAL BERHAD AND 2 OTHERS VS. TAN SRI DATO’ TAJUDIN RAMLI (“TSDTR”) (BY ORIGINAL CLAIM), TSDTR VS. CELCOM (MALAYSIA) BERHAD (“CELCOM”), TECHNOLOGY RESOURCES INDUSTRIES BERHAD (“TRI”) AND 36 OTHERS (BY COUNTERCLAIM)

Further to the announcement by Telekom (Malaysia) Berhad dated 7 September 2007 and announcement by Axiata dated 20 October 2008, the High Court had today delivered the following decisions with regard to the above matter:

A.allowed the appeal filed by TRI and Celcom against the decision of the Senior Assistant Registrar in dismissing their application to strike-out the amended counterclaim of TSDTR (“TSTDR’s Amended Counterclaim”). Following this decision, TSTDR’s Amended Counterclaim has been struck-out; and

B.allowed the appeal filed by TRI and Celcom against the decision of the Senior Assistant Registrar in allowing the re-amendment of TSDTR’s Amended Counterclaim for TSTDR to join 11 present or former directors and officers of TRI and Celcom (“Directors/Officers”) as defendants in this matter.Following this decision, the Directors/Officers are no longer parties to TSDTR’s Amended Counterclaim.

Axiata will make a further announcement of any material development on this matter from time to time.
