Axiata refers to its previous announcement dated 27 March 2009 wherein it was announced that the Court of Appeal had allowed the appeal made by Celcom (Malaysia) Berhad, a wholly owned subsidiary of Axiata (“Celcom”), and set aside the Order of the High Court dated 9 July 2008 granting Mohd Shuaib Ishak (‘MSI’) leave to commence a derivative action in Celcom’s name under Section 181A(1) of the Companies Act 1965 with costs.

Axiata wishes to announce that Celcom has today been notified by the Registry of the Federal Court that MSI had on 23 April 2009 filed an application for leave to appeal to the Federal Court against the above decision of the Court of Appeal and that the same is fixed for case management on 11 May 2009 in order to fix a date for hearing.

Axiata will make further announcement in respect of any material development on this matter.
