We refer to the above mentioned article that appeared in "Nanyang Siang Pau" on 10 December 2008 and in particular the following sentences which were carried in the said article:-

"The Company may also sell convertible preference shares to its controlling shareholder Khazanah Nasional Berhad"

TM International Berhad ("TMI") wishes to clarify that it is looking at achieving an optimal capital structure through equity or equity like instruments but have yet to decide on the structure. There are multiple options available to TMI and the TMI Group expects to finalize and announce the same by Q109.

TMI will make an appropriate announcement to Bursa Malaysia Securities Berhad ("Bursa Securities") and/or take the required actions in accordance with the Listing Requirements of the Bursa Securities in the event any corporate action is made.
