TM International Berhad ("TMI") refers to its previous announcement dated 9 July 2008 concerning its wholly-owned subsidiary Celcom (Malaysia) Berhad ("Celcom"), wherein it was announced that Mohd Shuaib Ishak has obtained leave to commence the derivative action in Celcom's name under Section 181A(1) of the Companies Act 1965 ("Derivative Action") (Kuala Lumpur High Court Originating Summons No. D5-24-20-2008).

The solicitors appointed by the Court to represent Celcom in the Derivative Action, Messrs. Lim Kian Leong & Co, have today served a copy of the sealed Writ of Summons and Statement of Claim in respect of the Derivative Action on Celcom's solicitors Messrs Shearn Delamore & Co.
