We refer to our announcement dated 16 September 2008 with regard to the decision of the High Court allowing the Plaintiffs' appeal ("Striking-Out Appeal") against the earlier decision of the High Court allowing Celcom's application to strike out the Plaintiffs' claim.

TM International Berhad ("TMI") wishes to announce that Celcom, a wholly-owned subsidiary of TMI, has today, filed a notice of appeal to the Court of Appeal against the whole of the Learned Judge of the High Court's decision in allowing the Striking-Out Appeal.

TMI will make further announcement in respect of any material development on this matter.
